These terms govern your use of salesmonsters.com. By using the Site you agree to them. If you do not agree, please do not use the Site.
1. Who we are and what this covers
Sales Monsters Inc. ("Sales Monsters," "we," "us," or "our") is a marketing agency based in Los Angeles, California. These Terms of Use ("Terms") cover our public website at salesmonsters.com and any pages under it (the "Site"). They do not cover the work we do for clients. That is governed by a signed proposal, statement of work, or services agreement (a "Service Agreement"). If these Terms and a Service Agreement conflict, the Service Agreement controls for that engagement.
2. Using the Site
You may use the Site to learn about Sales Monsters and to contact us. You agree not to:
- Use the Site for any unlawful purpose or in a way that violates these Terms.
- Copy, scrape, frame, or republish the Site or substantial parts of it without our written permission.
- Probe, scan, or test the vulnerability of the Site, bypass access controls, or interfere with its operation.
- Submit false or misleading information through our forms, or submit information about another person without their permission.
- Upload or transmit malware or anything else designed to damage or disrupt.
3. Information on the Site is not advice
The Site describes marketing problems and how we approach them. It is general information, not advice for your specific situation, and it is not legal, financial, tax, or professional advice. Results described on the Site, including client outcomes, are examples of past work. They are not a promise of what we will achieve for you. Your results will depend on your business, your market, your budget, and how the work is carried out.
4. Contacting us and proposals
Submitting a form or booking a call does not create a client relationship or obligate either of us to anything. Any engagement starts only when a Service Agreement is signed. Information you send us through the Site is handled as described in our Privacy Policy. Please do not send confidential information through the contact form.
5. Intellectual property
The Site, including its text, design, illustrations, characters, code, and the Sales Monsters name and logo, is owned by Sales Monsters and protected by copyright, trademark, and other laws. The monster characters and names on this Site are original work of Sales Monsters. You may view the Site and share links to it. You may not use our name, logo, or characters to suggest an endorsement or relationship that does not exist. Client and partner logos shown on the Site belong to their owners and appear to identify businesses we have worked with.
6. Third-party links and services
The Site links to and embeds third-party services, such as our contact form provider. Those services have their own terms and privacy practices, and we are not responsible for their content, availability, or conduct. A link does not mean we endorse the destination.
7. Availability and changes
We may change, suspend, or remove any part of the Site at any time without notice. We do not promise that the Site will always be available or free of errors.
8. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SALES MONSTERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SALES MONSTERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU IN FULL.
10. Indemnification
You agree to defend and indemnify Sales Monsters against claims, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Site in violation of these Terms or of any law.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top. Continued use of the Site after a change means you accept the updated Terms.
